What is the difference between a Buyer's Agent and A Seller's Agent and what does it mean to me?

Before you look at any property whether by yourself, at an open house, or with a Real Estate Agent, you need to know that unless you have a written agreement with a Real Estate Agent, everyone you speak to is working for the seller as a Seller's Agent.  You are NOT represented.  The only way you can have your interests protected is to have a written agreement with a licensed Real Estate Agent stating you want them to work for you as your Buyer's Agent.

When you sign a Buyer's Agency Agreement with a licensed Real Estate Agent, you will have access to ALL property for sale no matter who is the listing agent.  You WILL BE REPRESENTED and protected with a Buyer's Agency Agreement!!  Listed below are the duties and obligations of both a Buyers Agent and A Seller's Agent.  Who do you want to represent you when you buy your home?

BUYER'S AGENTS

A Buyer's Agent acts solely on behalf of the buyer when they have a signed Buyer's Agency Agreement with the buyer.


A Realtor acting as the Buyer's Agent has a legal obligation to:

  • Fully disclose to the buyer ALL FACTS that might affect or influence the buyer's decision to make an offer on the property
  • Promote the best interests of the buyer
  • Keep confidential, the buyer's motivations for buying
  • Present all offers on behalf of the buyer
  • Disclose to buyer all information known to the Buyer's Agent about the willingness of the seller to complete the sale or to accept a lower price.
